These Terms of Service ("Terms") govern access to and use of WebshopSensewise, a webshop conversion-optimization platform operated by Adam Jakab, a sole proprietor established in Hungary, trading under the brand name WebshopSensewise ("WebshopSensewise", "we", "us", or the "Provider"). By creating an account or using the Service, you ("Account Holder", "you") agree to these Terms. WebshopSensewise is intended exclusively for businesses, entrepreneurs, and professionals acting in a business capacity. By creating an account, you confirm that you are using the Service for business purposes and, where applicable, that you are authorized to accept these Terms on behalf of the business you represent.

1. The service

WebshopSensewise is a SaaS platform that helps online stores understand and improve visitor conversion. In summary, it lets an Account Holder:

  • embed a JavaScript tag on their webshop to measure visitor behavior (pageviews, clicks, scroll depth, cart activity);
  • configure automated on-site messages ("interventions" / rules), including an optional automatic selection mode ("Smart Selection");
  • send cart-abandonment recovery emails and back-in-stock notification emails to shoppers who provided their own email address on the store;
  • view analytics about the above in a dashboard.

WebshopSensewise is provided "as a service" - no software is installed on your own servers, and the embed script is served from WebshopSensewise's infrastructure.

2. Accounts & security

You're responsible for keeping your login credentials confidential and for all activity under your account. We strongly recommend enabling two-factor authentication (available in Account & Security). Tell us immediately at webshopsensewise@ygsaas.com if you suspect unauthorized access.

You can permanently delete your account and everything in stores you own at any time from Account & Security → Danger zone. This is immediate and cannot be undone - see Privacy Policy, section 6 for exactly what gets deleted.

3. Your store's visitor data & your responsibilities

For data collected from your own store's visitors and customers (analytics events, identified email addresses, cart-recovery and back-in-stock history), you are the data controller and WebshopSensewise acts only as your data processor - see Privacy Policy, section 2 for what this means in practice. As the data controller for your store, you're responsible for:

  • having your own privacy policy that discloses WebshopSensewise's tracking and email features to your shoppers, and that it is accurate to how you've actually configured the service;
  • obtaining any consent required under applicable law (e.g. GDPR/ePrivacy) before triggering window.Sensewise.grantConsent() from your own cookie/consent banner - the tracking script does not collect passive analytics data or create a visitor identifier until this is called, precisely so this choice stays in your hands. The consent gate can be switched off per store in Tracking Setup (for stores that do not need it); if you do, tracking starts immediately on every page that carries the tag, and you are solely responsible for having a lawful basis for that;
  • only using the "identify" and "subscribe for back-in-stock" features for shoppers who themselves took the corresponding action (e.g. entered their email at checkout, asked to be notified);
  • the content of any custom rule/intervention message and recovery email you configure;
  • having a lawful basis to email your shoppers, and complying with applicable anti-spam law (e.g. CAN-SPAM, EU ePrivacy) for any message you send through the platform.

4. Acceptable use

You agree not to use WebshopSensewise to:

  • collect visitor data without a lawful basis, or in violation of your own site's published privacy policy;
  • send unsolicited bulk email, or email to anyone who has unsubscribed or been suppressed;
  • attempt to access another account's data, probe or scan the service for vulnerabilities without permission, or otherwise interfere with the service's normal operation;
  • use the service for any store selling illegal goods or services, or in a way that violates applicable law.

We may suspend an account that we reasonably believe is doing any of the above - see section 8.

5. Plans, fees & billing

5.1 Plans

WebshopSensewise is offered in three plans, chosen per store (not per account): Free (EUR 0), Pro (EUR 29 per month) and Business (EUR 99 per month). What each plan includes (for example the number of active rules, the steps of cart recovery, Smart Selection, team seats and the monthly visitor allowance) is shown on the public pricing page and, for your own stores, on the Plan & billing page of the dashboard; the dashboard is authoritative for your store.

5.2 Visitor allowance

Each plan includes a monthly allowance of tracked visitors. It is a soft limit: we show your usage and warn you at 80% and 100%, but we do not switch tracking or your rules off when it is exceeded. If a store regularly exceeds its allowance, we may ask you to move to a plan that fits.

5.3 Payment

Paid plans are subscriptions billed monthly in advance and renew automatically each month until cancelled. Payments are processed by Stripe; your card details are entered on Stripe's pages and never reach us. By subscribing you authorize the recurring charge to your payment method. Prices are in euros and exclude VAT and other taxes unless stated otherwise; where VAT or a similar tax is due, it is charged in addition as required by law. Receipts and invoices are sent to the billing email address on the account.

5.4 Changing plans

You can upgrade or switch between paid plans on the Plan & billing page. An upgrade takes effect immediately and the price difference for the rest of the current billing period is charged right away (prorated). A switch to a cheaper plan takes effect immediately and the unused difference is credited against future invoices. Limits of the new plan apply only to adding new things - nothing you already set up is deleted or switched off automatically.

5.5 Cancellation

You can cancel at any time on the Plan & billing page. Cancellation takes effect at the end of the billing period you have already paid for; until then the store keeps the plan's features. After that the store moves to the Free plan. Your data is kept (see Privacy Policy, section 6); you can also delete your account at any time (section 2).

5.6 No refunds

Fees already paid are non-refundable, and we do not refund partial periods or unused time, except where mandatory law requires it or where the service was materially unavailable through our fault, in which case we will credit or refund the fees for the affected period.

5.7 Failed payments

If a payment fails, the payment provider retries it for a limited period and you will be asked to update your payment method. If the payment still cannot be collected, the subscription is cancelled and the store moves to the Free plan (nothing is deleted).

5.8 Price changes

We may change prices or plan contents. We will notify you by email at least 30 days before a change affecting a paid plan takes effect; it applies from your next renewal after that, and you can cancel before then. The Free plan may be changed or discontinued with reasonable notice.

6. Intellectual property

WebshopSensewise and its underlying software, design and branding remain our property. You keep all rights to your own store content, customer data, and any custom copy you write for rules/emails. You grant us a limited license to process that content solely to provide the service to you.

7. Availability & changes to the service

We aim to keep WebshopSensewise available and reliable, but we do not offer a formal uptime guarantee or service-level agreement. We may add, change or remove features over time; we'll try to give reasonable notice of any change that materially reduces functionality you rely on.

8. Suspension & termination

You may stop using WebshopSensewise and delete your account at any time (see section 2). We may suspend or terminate an account that violates section 4 (Acceptable use), with notice where practical, and without notice where necessary to protect the service or other users. Non-payment is handled as described in section 5.7. On termination, your data is deleted per Privacy Policy, section 6.

9. Disclaimer of warranties

The service is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by applicable law.

10. Limitation of liability

To the fullest extent permitted by law, WebshopSensewise will not be liable for indirect, incidental, special or consequential damages, or for lost profits or revenue, arising from your use of the service. Our total liability for any claim relating to the service is limited to the amount you paid us for the affected store in the 12 months before the claim arose.

Nothing in these Terms limits or excludes liability that cannot be limited or excluded under applicable law, including liability for intentional breach of contract, for damage to life, physical integrity or health, or for a criminal offence (see the Hungarian Civil Code, Act V of 2013).

11. Indemnification

You agree to indemnify and hold WebshopSensewise harmless from claims arising from your use of the service in violation of these Terms or applicable law, including claims from your own shoppers relating to your configuration or use of tracking/email features.

12. Data processing terms

For visitor and shopper data collected on your store, you are the controller and we are your processor (see section 3). This section forms the data processing agreement under Article 28 of the GDPR between you and us and applies for as long as we process that data.

  • Subject matter and purpose: providing the service you configured - analytics, on-site messages, cart-recovery emails and back-in-stock notifications.
  • Data and data subjects: your store's visitors and shoppers; pseudonymous visitor and session identifiers, behavioral events (page views, clicks, scroll depth, cart events), one-way hashed IP addresses, and the email addresses shoppers themselves provided.
  • Instructions: we process this data only on your documented instructions, which are these Terms and your configuration of the service in the dashboard.
  • Confidentiality and security: everyone who processes the data for us is bound by confidentiality, and we apply the measures described in Privacy Policy, section 8.
  • Sub-processors: you authorize the sub-processors listed in Privacy Policy, section 7. We will inform you of intended changes (for example by email) so that you can object.
  • Assistance: we help you respond to data subject requests and meet your security and breach-notification duties, taking into account the nature of the processing.
  • Personal data breaches: we notify you without undue delay after becoming aware of a breach affecting your store's data.
  • Deletion: visitor-level data is deleted automatically after the retention period (Privacy Policy, section 6), and all data of a store is deleted when you delete your account.
  • Information and audits: on request we provide the information needed to show compliance with this section.
  • Transfers: see Privacy Policy, section 11.

13. Governing law & disputes

These Terms are governed by Hungarian law, without regard to conflict-of-law rules. Disputes will be resolved by the court with jurisdiction at our registered office in Hungary, unless mandatory law gives you the right to bring a claim elsewhere.

14. Changes to these Terms

We may update these Terms from time to time. We will update the "Last updated" date above, and for material changes we will notify account holders by email at least 30 days before the change takes effect. Continued use after a change takes effect means you accept the updated Terms; if you do not accept them, you can cancel and delete your account before then.
